Terms of Service

This is a courtesy translation of the Italian original. If they differ, the Italian version prevails.

1. Who we are and what you accept

Attento! is a service by Cobalt Studio LLC, a United States company (“we”). These Terms are the contract between us and you.

By creating an account, installing the Attento! program or activating a subscription (at checkout you tick “I accept the Terms of Service”), you accept these Terms and declare that you have read the Privacy Policy. If you use Attento! for a business, you accept them on behalf of the business and declare that you can do so.

2. What Attento! is

Attento! alerts you on your phone when something moves in the zones you draw on the images from your cameras. The Attento! program, installed on one of your business's computers, watches the cameras, detects movement and sends us a short video, which reaches you with a notification. You can also switch the alarm on and off, choose the hours, and use the “Control room” and TV mode on the computer. With Pro you can watch the live view from your phone, the program recognises what is moving (a person, a vehicle, an animal, and which animal) and you can search your alerts by typing the way you speak (“Search”).

Some features may be marked as “preview”: we are still testing them and they may change or disappear.

4. Who can use it

You must be at least 18 years old. Attento! is designed for farms and businesses. If you use it as a consumer, that is, for purposes unrelated to your business, you also have the rights given to you by the Italian Consumer Code (Codice del Consumo), which these Terms do not limit.

5. Account and security

• You sign in with your Google account.
• You are responsible for what happens with your account. Keep your Google account, your phone and the computer with Attento! secure: anyone who uses that computer can see the cameras in the “Control room” and change the alarm.
• If you think someone is using your account, write to us immediately at help@cobaltstudio.app.

6. What you need

• Compatible network cameras (those that use ONVIF or RTSP, for example Tapo and Reolink) and their passwords.
• A Mac or Windows computer at your business, always on, with the Attento! program and connected to the same network as the cameras.
• An internet connection.
• A phone with notifications turned on: iPhone with iOS 16.4 or later (with Attento! added to the Home Screen) or Android with Chrome.

Cameras, computer, phone, internet and power are at your expense.

7. Plans, prices and payments

• Prices include VAT.
• You pay through Stripe, in advance, every month from the day you activate the subscription. The subscription renews automatically every month until you cancel it.
• Cancellation. At any time, from “Manage subscription” in the app. The subscription stays active until the end of the month already paid for; then the account goes back to Free and one camera works, the one you choose (if you do not choose, the first one you added). The others stay paused, with no alerts, live view or new photos, until you reactivate Pro; their zones and the earlier alerts remain. The live view from your phone, recognition and “Search” stop; your choices in “What alerts you” remain, for when you reactivate Pro.
• Extra cameras. They are an add-on to Pro: when Pro ends, they end too, with no further charges. If only the extra cameras end, those beyond the fourth stay paused in the same way.
• Pro as a gift. We may give you Pro as a gift for a period, for example in a promotion: we do not ask for your card and we do not charge you anything. If you do not have an account yet, the gift starts when you sign in for the first time with the email address we gave it to. During the gift, no extra cameras are added. At the end, or if we take it away earlier, the account goes back to Free automatically, as after a cancellation and with no charges; if you want to continue with Pro, you subscribe from the app.
• Refunds. We do not refund the current month, except as provided for consumers in section 8 and by law.
• Failed payment. Stripe tries again several times over the following days, and in the meantime Pro stays active. If the payment does not go through, the account goes back to Free, as after a cancellation.
• You will find receipts and invoices for your payments in “Manage subscription”.

8. If you are a consumer: right of withdrawal

If you use Attento! as a consumer, you may withdraw from a subscription within 14 days from when you activate it, without giving any reason: write to help@cobaltstudio.app (you may also use the model withdrawal form in the Italian Consumer Code). We refund you in full what you paid for that subscription within 14 days, using the same means of payment.

9. Your cameras: what you do

You are the one who decides where to put the cameras and what they film, and the responsibility is yours. In particular:

• film only the areas you have the right to monitor; avoid public roads, neighbours' property and other people's passageways, except for what is truly unavoidable;
• before the filmed areas, put up “Area under video surveillance” signs, with the information required by the Italian Data Protection Authority (Garante per la protezione dei dati personali);
• if the cameras can film employees or collaborators, before using them you need an agreement with the trade union representatives or authorisation from the Italian Labour Inspectorate (Ispettorato del lavoro) (Article 4 of the Italian Workers' Statute (Statuto dei lavoratori), Law 300/1970);
• do not film toilets, changing rooms and other places where people expect privacy;
• use Attento! only with cameras you have the right to use;
• for the images, you are the controller: inform the people filmed and respond to their requests. We will help you (section 10).

10. The images we process for you (Article 28 of the GDPR)

For the images from your cameras and the related data (videos, photos, live view, camera names, zones), you are the controller and we are the processor. This section is our agreement under Article 28 of the GDPR.

1. We process this data only to provide you with Attento!, in accordance with your instructions (the choices you make in the app and these Terms), and for no other purpose. If an instruction seems to us to be contrary to the law, we will tell you.
2. Anyone who works on this data for us is bound by confidentiality.
3. We protect this data with the measures described in section 8 of the Privacy Policy.
4. We are assisted by the sub-processors Hetzner Online GmbH (servers and backups in Germany), Anthropic and xAI (assistance and technical review on the servers, without looking at the images). You authorise them through these Terms. Before we add or change one, we will notify you, and you can object by closing your account.
5. We help you respond to requests from the people filmed, and with the obligations on security, impact assessment and breach notification (Articles 32–36 of the GDPR).
6. If we become aware of a breach of this data, we will tell you without undue delay, as the GDPR requires (Article 33).
7. Alert videos and photos are deleted after 7 days. When you close your account, we delete everything within 30 days; it disappears from the backups within a further 14 days.
8. We give you the information needed to demonstrate that we comply with these obligations, and we allow reasonable audits, with prior notice.
9. This data is on servers in Germany.

11. What you may not do

• Using Attento! to monitor people secretly or otherwise against the law.
• Connecting cameras you do not have the right to use.
• Trying to get into other people's accounts, cameras or computers, or into our servers.
• Overloading or disrupting the service, or circumventing its protections.
• Copying, modifying or decompiling the program, except as permitted by law.
• Reselling Attento! without an agreement with us.

12. The program for the computer

We grant you the non-exclusive, non-transferable right to install the Attento! program on your business's computers and to use it with your account for as long as you have the account. The program:

• checks your business's network every minute to find the cameras and connects to the ones you add;
• keeps roughly the last 30 seconds of video from each camera on the computer, so that it can also send you the seconds before the movement;
• starts by itself when you switch on the computer (you can turn this off from its menu) and keeps it awake;
• does not update itself: you download new versions from our website.

The program remains ours; the open source parts it contains remain their authors', under their licences.

13. Availability and changes

We do our best to keep Attento! working at all times, but we cannot guarantee it: there may be faults and maintenance. We may improve and change the features; if we remove something important from the Pro plan, you can cancel.

14. Liability

To the extent permitted by law:

• we are not liable for theft, damage or loss that Attento! did not report or did not prevent, nor for missed, late or incorrect alerts due to the causes in section 3;
• we are not liable for indirect damage, for example loss of profit;
• our total liability to you does not exceed what you paid us in the 12 months before the event.

These limits do not apply in cases of wilful misconduct or gross negligence, for personal injury and in the other cases where the law does not allow them, including consumers' rights.

15. Duration, closure and suspension

• The contract lasts for as long as you have the account.
• You can close your account at any time by writing to help@cobaltstudio.app: we will also cancel the subscription.
• We may suspend or close your account if you seriously breach these Terms (for example, illegal use of the cameras) or if you do not pay. When we can, we will notify you beforehand.
• We may also stop offering Attento!, or close an account for other reasons, with reasonable notice: in that case we will refund you the part already paid and not used.
• After closure, we delete the data as described in the Privacy Policy.

16. Changes to the Terms

We may update these Terms if the law or the service changes. The version that applies is the Italian one, published on the Italian page with the date at the top; translations into other languages, like this one, are only a courtesy. If the change is important, we will tell you by email or in the app; if you do not accept it, you can cancel and close your account.

17. Law and disputes

These Terms are governed by the law of the State of Delaware (United States). The courts of the State of Delaware have exclusive jurisdiction over any dispute.

If you are a consumer, you retain the rights given to you by the law of the country where you live, including the right to bring proceedings before the court of the place where you reside.

Before going to court, write to us: we will try to resolve it together. If any part of these Terms is not valid, the rest remains valid.
